This is an application for anticipatory bail in CR No.357 of 2020 registered with Vartaknagar Police Station for offence under Sections 323, 324, 504, 506 (II) and 427 r/w 34 of Indian Penal Code.

The applicant was granted interim protection by order dated 22nd December 2020. Learned APP, on instructions, submitted that during pendency of interim protection, the applicant was involved in another offence registered with Vartaknagar Police Station vide CR No.418 of 2020 for the offence u/s 324 of Indian Penal Code. It appears that the applicant was arrested in that case and subsequently released on bail.

Learned APP has also pointed out that six cases were registered against applicant. Learned counsel for applicant, however, submits that in all those cases the applicant has been acquitted.

The prosecution case is that on 4th November 2020 quarrel had ensued between applicant and the complainant. It is alleged that the applicant was under the influence of liquor and he has assaulted the complainant. The matter was compromised on intervention of mother of applicant. However, on the next date, applicant again approached the complainant with his three associates armed with weapons and threatened the complainant.

Considering the facts of prosecution case and also considering the fact that during pendency of interim protection, the applicant is involved in one more case, no case for granting this application is made out. The Anticipatory Bail Application is rejected. 6.
