This application is preferred by applicant original claimant for dispensing with the service on original respondent no. 2, owner of the vehicle in an application for withdrawal of the amount deposited by the Insurance Company.

(I) Application is allowed in terms of prayer clauses (a) and (b) which read thus:
"(a) Service of notice upon the Respondent No. 2 in Civil Application No. (ST) 26647 of 2016 in First Appeal No. 1112 of 2016 may be dispensed with;
(b) Affirmation of the petitioner be dispensed with". (II) No order as to costs.
