Mr.Agarwal, learned counsel for the petitioner fairly invited my attention to Section 35 of the Bombay Prevention and Fragmentation and Consolidation of Holdings Act, 1947 (for short "the said Act") and would submit that his client would file a revision application under section 35 of the said Act before the State Government within two weeks from today. Statement is accepted.

If any revision application is filed, the same shall be served upon the contesting respondents. The State Government shall decide the matter expeditiously and not later than three months from the date of the first meeting. If any application is made for exclusion of time taken in this petition, the State Government shall consider the fact that the petition was filed in this Court in good faith and was prosecuted with due diligence. 3.

Writ petition is dismissed as withdrawn with liberty as prayed with aforesaid clarification. No order as to costs. R.D. DHANUKA, J.
