In view of this, the learned counsel for the applicant, upon instructions, seeks liberty to withdraw the application. Liberty as prayed for is granted in the interest of justice with further liberty to move the Sessions Court in the changed circumstances under Section 439 of Cr.P.C. The learned Sessions Judge shall decide the application on its own merits without being influenced by the withdrawal of this application. Application stands dismissed as withdrawn.
