Petitioner has impugned Order dated 22.06.2021 passed by the Competent Authority thereby rejecting his Application for furlough leave on the ground of adverse police report. 2.

The grounds on which the Application of Petitioner has been rejected by the Competent Authority appears to us to be very vague and based only on police report without recording subjective satisfaction in that behalf.

In view thereof, we hereby set aside the Order dated 22.06.2021 passed by the Competent Authority and direct the concerned Authority to consider the Application of Petitioner as per the Circular dated 17.08.2022 issued by the Additional Director General and Inspector General of Prisons, Maharashtra State.

The Competent Authority is directed to consider the said Application on its own merits within a period of four weeks from the 1/2
