Mr. Sugdare, learned counsel for the Appellant / Applicant states that wrongly the Appeal is filed before this Court. It is his submission that it should have been filed before the District Court, Pune and therefore, he prays for withdrawal of this Appeal with liberty to file before the appropriate Court. Statement accepted. 2.

The Appeal is disposed of with liberty as prayed for. 3.

In view of disposal of the Appeal, nothing survives for

Needless to mention that if the Appeal is filed before the District Court within a period of two weeks from today and if the said Appeal is accompanied with an Application for condonation of delay, it is expected from the learned Judge to consider the same in the light of law of limitation.
