Heard the learned Advocates appearing for the parties and the following order is passed by consent :

i.

The Award dated 6 th May, 2014 passed by the 1 st Labour Court, Nashik in Reference (IDA) No. 37 of 2013 is set aside.

ii.

The 1 st Labour Court, Nashik shall hear the parties and decide Reference (IDA) No. 37 of 2013 afresh and pass his Award within a period of 10 weeks from today.

iii.

The Petitioner shall be at liberty to file its Written Statement as well as the evidence and documents within a period of four weeks from today. The Respondent shall also be at liberty to file his evidence along with documents within a period of two weeks thereafter.

The 1 st Labour Court, Nashik shall not grant any adjournment to the parties unless absolutely necessary and may proceed with the matter on day to day basis upon the Petitioner filing its Written Statement along with Affidavit of Documents. v.

All contentions of the parties are kept open. vi.

The Sub Divisional Engineer, PWD Sub Division No. 2, Dindori, District - Nashik undertakes to pay Rs.10,000/- towards costs to the Respondent within a period of one week from today. The undertaking is accepted. 2.
