This is an application for condonation of delay of 86 days in filing Second Appeal.

Mr. Tajane submitted that no sufficient cause is made out for condoning the delay. He invited my attention to paragraph 2 of the application.

Having regard to the fact that the delay is of 86 days, in the interest of justice the Application deserves to be
2/2 CAS/1043/2014 allowed so as to decide Appeal on merits, rather than dismissing it on technical ground. Hence, Civil Application is allowed in terms of prayer clause (a) with no order as to costs. Office is directed to register Appeal, if it is otherwise ready.
