The learned counsel appearing for the Petitioner submits that since last many days none from the Petitioner has in contact with him or has given any instructions. The learned Counsel submits that he is not having the instructions, as regards to the present status of the company and whether the company is still functioning or otherwise. The learned counsel further submits that the communications send by him to the company on the known address are returned unserved. In the circumstances, the learned counsel has expressed his inability to proceed with the matter.

Perused the record of the case. It reveals that even Respondent is not attending the present proceeding. There is every reason to believe that the Petitioner and the Respondent No.1 both have lost interest in prosecuting the matter. Even otherwise, by efflux of time, the matter seems to have become infructuous. There seems no propriety in keeping the matter pending. The Petition, hence stands dismissed for want of prosecution.
