The learned counsel for the Petitioner filed praecipe for fixing an early date of hearing. He submits that by this Writ Petition, they are challenging the order dated 19.01.2016 passed by the District Judge, Alibaug in Misc. Application No.18/2015 dismissing their Application for condonation of delay. He submits that by mistake, they filed the Writ Petition instead of a Second Appeal. He further submits that he received instructions from his client to withdraw the Writ Petition with liberty to prefer a Second Appeal. To that effect, he has given in writing.
