IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CIVIL APPELLATE JURISDICTION WRIT PETITION NO.1430 OF 1996 (Kalyani Apparels Vs. Deepak R. Shah) Office Notes, Office Memoranda of Coram, appearances,Court's orders, or directions, and Registrar's Orders Court's or Judge's orders None for Petitioner.

CORAM : R. G. KETKAR, J.

DATE : 29TH JUNE, 2018 P.C.:

None appears for the petitioner.

2.

By order dated 07.03.1996, Petition was admitted by issuing Rule and interim order in terms of prayer clause (b) was granted. In the order dated 17.07.2017, it was noted that Advocate V. G. Mujumdar, representing the petitioner, expired. Accordingly, notice was issued to the petitioner. Office remark dated 07.06.2018 shows that petitioner has refused to accept the notice issued on Court motion. Thus, despite service, neither a representative of the petitioner appears nor petitioner has entered appearance through Advocate. Hence, Petition is dismissed in default. Rule is discharged with no order as to costs.
