Heard Mr. Nagvekar, learned Counsel for the petitioner and Mr.Udane, learned Counsel for the respondent. 2.

Mr. Udane undertakes to this Court that within one week from today, he will file appearance on behalf of the respondent. Undertaking given by Mr. Udane is accepted. Office to accept Vakalatnama. 3.

The Petition was heard on 11.04.2019. By that order, the parties were referred to the Marriage Counsellor attached to the Family Court, Pune and the Marriage Counsellor was requested to mediate and submit report to this Court on or before 26.04.2019. In pursuance thereof, Ms Sandhya Chavan, Marriage Counsellor, Family Court, Pune has submitted report dated 24.04.2019 enclosing therewith consent terms signed by the parties on 24.04.2019 as also by the Marriage Counsellor. The covering letter, Counsellor's report and the consent terms are taken on record and marked 'X colly.' for identification. 4.

In view thereof, Mr. Nagvekar submitted that parties have agreed to dissolve the marriage by mutual consent. Mr. Udane confirms the same. Learned Counsel for the parties submit that they will place the 1/2

WP6842_18.doc consent terms before the learned trial Judge of the Family Court for passing appropriate orders. The parties assure that they will appear before the learned trial Judge on 03.05.2019 and for that purpose, no fresh notice be issued to them.

Mr. Nagvekar states that petitioner is present in the Court. He has tendered photocopy of her Aadhar Card, which is taken on record and marked 'Y' for identification. Upon taking instructions from the petitioner, he seeks permission to withdraw the Petition. 6.

In view thereof, on the motion made by Mr. Nagvekar, Petition is allowed to be withdrawn and is disposed of as such. The parties will appear before the learned trial Judge on 03.05.2019, and for that purpose, no fresh notice be issued to them. The learned trial Judge will fix the suitable date and thereafter proceed with the matter. The Registry shall forthwith transmit the original consent terms to the Family Court, Pune by retaining photocopy of the consent terms on record. Order accordingly.
