At the outset, learned counsel for the Respondent No.1, states that the trial has commenced, inasmuch as, the matter is posted for recording of the evidence of the petitioner. He submits that the recording of respondents evidence is over.

In view of the fact, that the trial has already commenced, no interference is warranted in the impugned order.
