.
Rule. By consent of the parties, Rule is made returnable forthwith. Learned counsel for the first Respondent waives service. Learned counsel for the second Respondent waives service. 2.
It is not in dispute that on record of Writ Petition No.2888/2014 filed by one of a co-accused, Deed of Settlement between the accused and the second Respondent is placed on record. On the basis of the said Deed of Settlement, the FIR has been quashed by a separate order passed today as far as Petitioner in Criminal Writ Petition No.2888/2014 is concerned.
3.
The learned counsel for the second Respondent on instructions states that the second Respondent has no objection for quashing the FIR as against the Petitioner in view of the settlement. The first informant has filed an affidavit to that effect. 4.
For the reasons recorded in a separate order passed today
rsk 2 58-WP-2315-16.doc in Criminal Writ Petition No.2888/2014, we pass the following order: (i) Rule is made absolute in terms of prayer clause (b) which reads thus:
"b. This Hon'ble Court be pleased to quash and set aside this C.R. No.550 of 2014 dated 30th June 2014 registered at Satara City Police Station and the consequent proceedings arising there from against all Petitioners." (ANUJA PRABHUDESSAI,J) (A.S.OKA,J.)
