1] Leave to amend. Amendment to be carried out forthwith. Learned counsel for the applicant on instructions from the applicant who is in jail made a statement that entire amount of Rs. 34,05,000/- which is defalcated as is reflected in the F.I.R. shall be deposited in the Trial Court within period of one year i.e. by 31/12/2022. It is further claimed that said amount shall be deposited in installments which shall commence from 01/06/2022 and each installment of Rs. 6 Lakhs to be deposited by the end of each month of English calender in the Trial Court. 1/3

2] Since the statement is made on instructions, same is accepted as an undertaking to this Court.

3] In view of above, applicant is directed to be released on bail. (i) Applicant be released on bail in C.R. No. 108/2019 registered with D. N. Nagar Police Station for offence punishable under Sections 419, 420, 406 r/w 34 of Indian Penal Code upon furnishing P.R. bond in the sum of Rs. 25,000/- with one or more sureties in the like amount.

(ii) Applicant shall neither influence the prosecution witnesses in any manner nor tamper with the evidence.

(iii) Applicant shall attend the Trial Court in first week of every English calender month and so also Investigating Officer.

(iv) If the undertaking given to this Court is not 2/3

honoured i.e. applicant fails to deposit the amount as has been mentioned herein above, the Trial Court shall be at liberty to take the applicant in custody forthwith.
