Heard learned counsel appearing for the Applicant. In view of the averments made in the Application, a case for restoration of the Writ Petition which was dismissed against the third Respondent is made out. Accordingly, the Application is allowed in terms of prayer clause (a).

Issue fresh notice to the third Respondent, returnable on 30th November 2015.

In addition to the service through Court, private service is permitted to the third Respondent. 4.

If proper affidavit of service is not filed within one week before the next date, the Petition shall stand dismissed for non-prosecution without further reference to the Court.
