Petitioner in this petition under Article 227 of the Constitution of India read with Section 407 of the Code of Criminal Procedure, seeks transfer of proceeding in Anticipatory Bail Application No. 490/2021 from the Court of Additional District Judge and Sessions Judge - 1, Kalyan to any other Court Najeeb.. 1/2

32.WP-3146-2021.doc within the Sessions Division. In my view, it would be appropriate, if the Petitioner invokes the jurisdiction of the learned Sessions Judge under Section 408 of the Code of Criminal Procedure. 2.

In view of this, petition is disposed of with liberty to approach the Sessions Judge for seeking similar relief, as sought in this petition. If such an application is made, the learned Sessions Judge shall exercise the jurisdiction within two weeks from the receipt of the application.
