Heard both sides in this application for recalling the Order dated 09/05/2017 passed in the appeal.

On 09/05/2017, this Court had directed issuance of bailable warrant in the sum of Rs.20,000/- against the appellant as none appeared for the appellant when the appeal was called out for final hearing.

(13)APPANo.9092017 In fact, the learned Advocate for the applicant submitted that he will be appearing for the appellant as and when the matter is called out for final hearing.

In this view of the matter, now there is no propriety in securing the attendance of the appellant through bailable warrant. Hence, the Order directing issuance of bailable warrant against the applicant/appellant is recalled.

The application is accordingly disposed of.
