DATE :

7th SEPTEMBER 2018.

P.C. :

Pallavi Mahendra Wargaonkar The only substantive relief sought in this petition is in terms of prayer clause (a) which reads thus :- (a) that this Hon'ble Court be please to issue the Writ of Mandamus or any such appropriate Writ in the nature of Mandamus and direct the Hon'ble MRT, Mumbai with to decide the Appeal No.APL/TNC/NSK/L-5/16 and Restoration Application No.Rest/TNC/NSK/L-393/16 expeditiously and preferably within a period of four weeks."

The learned counsel appearing for the petitioners states that restoration application is also dismissed. Therefore, prayer clause (a) will not survive.

In any event, if the petitioners want to seek a direction against the Maharashtra Revenue Tribunal directing the Tribunal to decide the application expeditiously, the remedy of the petitioners is to seek that relief by making appropriate application before the Tribunal. Subject to what is observed above, the petition is disposed of.
