This is the second bail application. The applicant/accused is facing charges for the offences punishable under Sections 302, 307, 147, 148, 149, 341, 323, 120(B) and 427 of the Indian Penal Code and under Sections 3(i), (ii), 3(2) and 3(4) of Maharashtra Control of Organized Crime Act (MCOC).

The learned counsel for the applicant/accused submits that the applicant/accused is in the prison since 7th June, 2010. He has completed more than five years and therefore the trial be 1 / 2

28-ba-1304-2015.doc expedited as the charge is yet not framed. She submits that she is not pressing the application and prays to expedite the matter. 3.

The learned prosecutor points out that the earlier two bail application No. 1927 of 2014 was rejected by this Court. The first bail application was rejected on 5th March, 2015. He submitted that in this matter the stay was granted as the wife of the co-accused has moved before the Division Bench and now the stay is vacated. 4.

The applicant/accused is in prison since last five years and if there is no stay then, the trial Court to proceed with the matter expeditiously and the matter to be completed within one year. 5.

The Registrar(J) is requested to communicate this order to the learned Principal Judge, Pune and concerned learned Judge of the MCOC Court, Pune.

With the aforesaid direction, the application stands disposed of as withdrawn.
