The petitioner has preferred this petition through jail. Hence, we appoint Adv. Ms. Nasreen S. K.Ayubi, who is on the panel of Advocates of High Court Legal Services Committee, to represent the petitioner in this petition.

Heard both sides.

The petitioner (detenue) has preferred this petition against the detention order, issued against him under the Maharashtra Prevention of

Dangerous Activities Act (MPDA), by the Commissioner of Police, Nagpur City. The order was executed on the petitioner and he was detained in Nashik Road Central Prison. As stated earlier, the petitioner has assailed the order of detention.

The learned APP has tendered a report dated 7th January, 2016, of Superintendent, Nashik Road Central Prison, Nashik Road, which is taken on record and marked "X" for identification. By the said report, Superintendent, Nashik Road Central Prison, has reported that the petitioner has been released from jail.

In view of above, the petition becomes infructuous. Hence, rule is discharged.
