By this Petition under Article 227 of the Constitution of India, Petitioner is challenging the order dated 3rd June, 2017 passed by the Additional Commissioner, Pune Division, Pune in Grampanchayat Appeal No.

248 of 2014 remanding the matter i.e.

Grampanchayat Dispute Application No. 30 of 2014 to the Additional Collector, Pune for deciding on its own merits.

The learned AGP Mr. Kankal appearing on behalf of State submit that he

Yadav VG 2 909.wp.7717.17.odt. received instructions that the Additional Collector, Pune that Authority will decide the Grampanchayat Dispute Application No. 30 of 2014 within three months from today. The statement is accepted.

The learned Counsel for Petitioner submit that Petitioner - Shri Sanjay Vishnu Sawant is present in Court. His presence is recorded.

The learned Counsel Mr. Sawant for Petitioner submit in view of the statement made by the learned AGP, he received instructions from his client who is present in Court to withdraw the present writ petition.

To that effect, he has given in writing. Same is taken on record and marked "X" for identification. Same is accepted.

Liberty is granted to the Respondent No. 1 - Shri Sanjay Shankarrao Pavale to appear before the Additional Collector, Pune and submit his grievance according to law.

In view of above mentioned facts, following order is passed.

ORDER

(a) The Additional Collector, Pune to decide the Grampanchayat Dispute Application No. 30 of 2014 as early as possible, but in any case within three months

(b) All the parties to appear before the Additional Collector, Pune on 18th August, 2017 at 11.00 a.m. for filing additional pleadings, if any, and for fixing the date of hearing.

(c) Writ Petition stand disposed, as withdrawn.

(d) No order as to to costs.

(e) Parties to act on the authenticated copy of this order.
