Heard the learned counsel for the parties.

This application is preferred by wife under Section 24 of Code of Civil Procedure, 1908 for transfer of Marriage petition filed by the respondent husband bearing M.P. No.8/13/A under Section 13(1)(ia)(ib) of the Hindu Marriage Act in the Court of Civil Judge, Senior Division, Ponda to the Family Court at Pune.

The learned counsel for the respondent husband makes a statement that the respondent husband filed application dated 28.4.2015 in the Trial Court for withdrawal of Marriage Petition. Same was allowed by the court. He placed on record photo copy of application dated 28.4.2015 1/3

and order passed by the court. Same is taken on record and marked 'X' for identification.

In view of subsequent development, nothing survives in the Misc. Civil Application. Hence, same stand rejected as infructuous.
