By the above Miscellaneous Civil Application filed under Section 24 of the Code of Civil Procedure, 1908, the Applicant-wife seeks transfer of Hindu Marriage Petition No.1453 of 2016 filed by the Respondent-husband seeking divorce pending before the Court of Civil Judge, Senior Division at Pune to the Court of Civil Judge, Senior Division at Sangli.

Both the parties are educated. The Respondent-husband is an M.B.A., and the Applicant-wife is a B.Com. Keeping in mind, the convenience of both the parties, the following order is passed.

(i) The Court of Civil Judge, Senior Division at Pune shall conduct the proceedings in Hindu Marriage Petition No.1453 of 2016 through videoconferencing. In the event of any difficulty, the Respondent undertakes to provide to

kpd 2 / 2 37-MCA-201-2017.sxw the Court a laptop, WIFI and other equipments necessary to conduct the proceedings through video-conferencing.

(ii) The Court of Civil Judge, Senior Division at Sangli shall allow the Applicant and her Advocate to use the video-conferencing facilities available with the Court to conduct the proceedings in Hindu Marriage Petition No. A-1528 of 2016 through video-conferencing on the dates fixed by the Court of Civil Judge Senior Division at Pune.

(iii) The Court of Civil Judge, Senior Division at Pune shall endevour to dispose off the Hindu Marriage Petition No. 1453 of 2016 within a period of six months from the date of this Order.

(iv) The parties shall not seek adjournment/s unless absolutely necessary. The Court of Civil Judge, Senior Division at Pune shall also not grant adjournment/s to either side unless absolutely necessary. (v) Since the proceedings shall be conducted through videoconferencing, the Court of Civil Judge, Senior Division at Pune shall fix the hearing of the matter at the time specified in advance.

The above Miscellaneous Civil Application No. 201 of 2017 is accordingly disposed off.
