The order impugned attaches the salary of the respondent/husband under section 60 of the Code of Civil Procedure to the extent of one-third. According to the petitioner, his salary is Rs.48,000/-. The wife disputes the said position. 2.

Assuming the statement on behalf of the husband is correct,

43-wp3029-2019.doc the total liability of the husband as per order passed in the proceedings before the learned Magistrate and Family Court exceeds one-third of the salary.

In that view of the matter, there is no error apparent on the face of record nor error of jurisdiction involved in the impugned order.

The writ petition is, therefore, dismissed. No costs. (AMIT BORKAR, J.)
