Learned counsel for the Applicant seeks permission to withdraw the present application and though in the praecipe it is stated that withdrawal is sought on the ground that the Applicant wants to approach the trial Court in view of the filing of charge-sheet, learned counsel appearing for the Applicant fairly states that, today the Applicant has informed her that he has already availed the benefit from the Sessions Court on 24/08/2021.

The present application is filed on 12/08/2021 and the Applicant had simultaneously approached the Sessions Court by filing another application, seeking his release on bail and it is without disclosing about filing of the application in this M.M.Salgaonkar

2/2 3 BA-2926-21.doc Court. The aforesaid facts make clear that the Applicant has simultaneously invoked the jurisdiction of both the Courts and with an expectation that he can take chance. For this action, though the withdrawal of application is permitted, the Applicant must pay costs of Rs.10,000/- to the High Court Legal Services Authority, Mumbai, as he has misused the jurisdiction of this Court. The amount shall be deposited within a period of one week from today and receipt of the same be tendered in the Registry of this Court.
