P.C. :
The Petitioner has alleged contempt on the part of the Authorities of the Respondent- State in not implementing the order dated 12 August 2021 passed in Writ Petition No.3350/2021. 2.
The learned AGP points out and places on record the order passed by the Hon'ble Supreme Court in Civil Appeal No.9512/2018 in a group of matters which also includes the special leave petition in respect of the present Petitioner which is filed by the State challenging the order dated 12 August 2021. In this Civil Appeal, a statement has been made on behalf of the State
skn 2 26-CP513.2022.doc Government that meetings have taken place with the Union of the Petitioner and the State is considering to extend the benefits and the matter is adjourned to 21 February 2024.
3.
Therefore, the State has challenged the order of which contempt is alleged and the matter is under consideration of the Hon'ble Supreme Court where some statements are made. The action of the Respondent- State, therefore, cannot be considered as contemptuous. As to whether the State should comply with the order dated 12 August 2021 would now be considered by the Hon'ble Supreme Court in the pending Civil Appeal. 4.
Therefore, we do not intend to keep the contempt petition pending. Contempt petition is accordingly disposed of. (M.M. SATHAYE, J.) (NITIN JAMDAR, J.)
