Heard the learned counsel for the parties.

The limited challenge in this petition is to an order dated 5th January, 2023 passed by the learned Presiding Officer, Labour Court, Thane whereby the Labour Court directed the second partyworkman to lead evidence in proof of the plea that second party has been illegally terminated.

The learned counsel for respondent- first party/ employer submits that the respondent has already filed an affidavit in lieu of examination in chief and the respondent is willing to lead its evidence first.

In view of the aforesaid statement, the petition stands disposed with a request to the Labour Court, Thane to first record the evidence of first party/ employer and after conclusion of the Vishal Parekar ...1

5.

The second party/ employee workman shall complete the cross examination of the first witness of the first party and the witnesses which may be examined, without seeking unwarranted adjournment 6.
