Petitioner - Amit Gala seeks custody of daughter of respondent no.2 - Suresh Jain. We have heard learned counsel for the petitioner as also respondent no.2 and learned APP for respondent no.1 - State.

Daughter of Suresh Jain, namely, Riya, is present before the

wp-2737-15 court. She has identified by counsel for petitioner and respondent no.2. Her statement has been recorded in our chamber in the presence of learned counsel for the parties.

In view of the statement given by Riya in court in the absence of her father - Suresh and in the absence of petitioner - Amit, we find that no orders can be passed in favour of the petitioner in the present matter. 4.

Petition is accordingly disposed off.
