Learned counsel for the petitioner on instructions seeks leave to withdraw the petition with liberty to file an appropriate proceedings as permissible under the Bombay Prevention of Fragmentation and Consolidation of Holdings (Amendment) Act, 1977 ('the said Act'). He submits that ad-interim protection granted by this court be extended for a limited time to enable the petitioner to file an appropriate proceedings and also seek interim protection. 2.

Since, there is an alternate and efficacious remedy available Page no. 1 of 2

21-wp-8055-2023.doc to the petitioner under the said Act. Leave is granted with liberty as prayed. Writ petition is disposed of as withdrawn with liberty to adopt appropriate proceedings under the said Act. 3.

Ad-interim protection granted by this court vide order dated 4th July 2023, to continue for a period of six weeks from today, subject to petitioner adopting alternate appropriate remedy as permissible under the said Act within a period of four weeks from today. 4.

Writ petition is disposed of as withdrawn with liberty as aforesaid.
