The learned counsel for the applicant submits that till today, the prosecution has examined 8 witnesses. This Court had rejected the application on merits vide order dated 13th February 2017 after considering the records. On 19th December 2019, this Court had observed that the prosecution has recorded substantive evidence of 4 witnesses. As on today, 8 witnesses are examined. Accused are being tried under the provisions of Maharashtra Control of Organised Crime Act, 1999 and under sections 395, 397, 342 r/w 120-B of the Indian Penal Code. Since the trial is in progress, no case is made out for grant of bail.
