P.C. :- Learned Counsel for the applicant upon instructions seeks liberty to withdraw the application. Liberty as prayed for is granted in the interest of justice. The application stands dismissed as withdrawn. The learned counsel further submit that the applicant would appear before the concerned Court on or before 23.07.2015. It is clear from the record that the applicant was not physically present at the scene of offence. It is doubtful as to whether an offence under Sections 395, 354 could be made out against the present applicant. Learned Magistrate shall consider the application on its own merits without being influenced by the withdrawal of this application. The applicants stand protected till 5.00 p.m. of 23.07.2015.
