DATED : 8th AUGUST, 2023 P.C:- This is a second bail application; the first being rejected by the detailed order on 22/07/2022 and the order having been upheld by the Supreme Court on 5/12/2022, the only ground which is pressed into service is that one of the co-accused has been released on bail.

I have perused the order in case of co-accused passed on 7/06/2023, but I am unable to conform myself with the observation therein. While rejecting the bail application of the applicant, who is accused of a serious offence of Section 302 with all the gravity that surfaced through the charge-sheet, I had rejected the application on merits.

There is no reason to recall the said order, as in the facts and circumstances of the case considering the role attributed to the accused in the charge-sheet, the application was rejected. ( SMT. BHARATI DANGRE, J.) Ashish
