The learned APP has tendered the Affidavit of the investigating officer. The same is taken on record. 2.

The applicant, who is facing prosecution inter-alia for the offence punishable under Section 302 of Indian Penal Code has filed this application under Section 439 of the Code of Criminal Procedure, 1973 for grant of bail.

The bail is sought inter-alia on the ground of prolong incarceration as an undertrial.

The learned Senior Counsel for the applicant submits that the applicant is in jail for more than six years. 5.

Considering the facts and circumstances of the case, the trial court shall endeavour to conclude the trial as early as possible. If the trial is not concluded within a period of 6 months from the date of receipt of copy of this order by the trial Court, the applicant is at liberty to circulate this application after expiry of the said period.
