Heard learned Counsel for parties.

This application is for carrying out amendment in writ petition as per Schedule on Page 13 of the Civil Application.

The learned Counsel for Applicant Ms. Awasthi submit that Applicant want to bring on record the subsequent events which are necessary to decide the main issue in the writ petition.

On the other hand, the learned Counsel Mr. Gavnekar appearing on behalf of Respondent - Society vehemently opposed for granting the Civil Application. He submits that the main issue in writ petition is in respect of the order passed under section 101 of the Maharashtra Co-operative societies Act, therefore, there is no question of allowing the Civil Application.

It is to be noted that till today the writ petition is not admitted by this Court. It is pending for hearing on its own merits.

Considering these facts, Civil Application is allowed in terms of prayer clause (a) which read thus :

Yadav VG 3 24.caw.1668.17.odt. (a) That the Applicant be allowed to amend the above petition as per Schedule annexed hereto.

(b) Amendment to be carried out within three weeks from today, failing which, the Civil Application shall stand dismissed without reference back to the Court.

(c) If the amendment is carried out within stipulated time as stated above, the Applicant to serve the amended copy of writ petition on Respondents or their Advocate thereafter within four weeks from today.

(d) Liberty is granted to the Respondents, if they so desire, to file additional Affidavit-in-reply within six weeks from today with copy to other side.

(e) Civil Application stand disposed of accordingly.
