There is no necessity to frame any additional issue as proposed by the Petitioners. This is because, the Court has, on 26/06/2014, already framed an issue as to whether the Plaintiff proves that she is the owner of the suit premises. The issue which the Petitioner-Defendant seeks to frame, is obviously included within the aforesaid issue.

With this clarification, there is no necessity to interfere with the impugned order. Writ Petition is dismissed. (M. S. SONAK, J.) URS
