Heard. This is an application filed under Section 438 of the Criminal Procedure Code.

The Applicant herein is seeking transit bail. The Applicant is residing at Pune. That a private complaint is registered against the Applicant in the Metropolitan Magistrate Court at Calcutta for offences punishable under section 406 and 420 of the Indian Penal Code.

The learned counsel for the Applicant, upon instructions, submits that the Applicant has not received summons in Complaint Case No. CS/77422 of V.A. Tikam 1/2
2017. He had no knowledge about the pendency of the case. That on 19th of March, 2018, a warrant is issued against the Applicant and the next date was 28th May, 2018. Once again a warrant is issued and the next date is 8th of August, 2018. The learned counsel for the Applicant submits that the Applicant had received the summons, he had no knowledge about the pendency of the said case.

In view of this, the Applicant deserves transit bail in order to facilitate his appearance before the Learned Metropolitan Magistrate at Calcutta in Complaint Case No. CS/77422 of 2017. Hence, applicant stands protected till 5.00 p.m. of 16th July, 2018. The Applicant shall appear before the Metropolitan Magistrate at Calcutta.
The application is allowed in the aforesaid terms and disposed of accordingly.
