Learned counsel for the Petitioner and Respondent state that the matter has been amicably settled. They have placed on record the Consent Terms which reads thus :- " 2. During the pendency of the above Writ Petition, the Petitioner has approached the Trustees of the Respondent Trust and requested them to settle the matter as he is not interested in pursuing the caption matter any further. Accordingly, the Respondent upon the specific request of the Petitioner has agreed to settle the dispute once for all as follows :

a) The Respondent shall pay a consolidated gross one time amount of Rs.10,00,000/- (Rupees Ten Lakh Only) towards full and final settlement of all the claims of the Petitioner subject to TDS including all taxes, duties and on 1/3

account of any social security dues and all the claims of whatsoever nature towards reinstatement, continuity of services, back wages, etc.

b) The Petitioner admits that Monday, 20th June, 2016 is accepted by him as his last working day with the Respondent Trust.

c) Upon receipt of the aforesaid amount, the Petitioner shall not in future claim any other further dues/amounts of whatsoever nature pertaining to his service with the Respondent Trust or for any other reasons whatsoever. d) The Petitioner confirms that he shall not institute in future any legal proceeding of whatsoever nature in any court of law and/or with any other authority in respect of the subject matter covered by the captioned writ petition. 3.

Thus, the Petitioner and the Respondent have amicably settled all their disputes and pending differences in the aforesaid matter on the above terms and conditions. 4.

The Petitioner and the Respondent state that the Consent Terms have been arrived at and agreed to by both the parties in a consultative manner totally out of their free will and volition and without any coercion and undue influence being exerted on them.

The Petitioner and the Respondent respectfully pray to this Hon'ble Court to accordingly dispose of the captioned writ petition in terms of these consent terms. " 2/3

The Petitioner and the authorized signatory of the Respondent are present before the Court. They are identified by their respective counsel. The Petitioner and the authorized signatory have identified their signatures and have confirmed the contents of the Consent Terms. Hence, the Consent Terms are taken on record and marked as ' X' for identification. Statements made in the Consent Terms are accepted as an undertaking to the Court.
