At the relevant time, the petitioner had filed an application with the competent authority to transfer him from Kolhapur Central Prison to Thane Central Prison, which came to be rejected.

If the grievance of the petitioner still subsists, petitioner is granted liberty to file application afresh before the concerned authority. In case such application is filed, the concerned authority shall consider the same in view of the changed circumstances and also taking into consideration the grievance expressed in the disposed of application that the petitioner belongs to poor family and his family members could not meet him for the last 12 years.
