Heard learned Counsel for the parties.

This applicant is for bringing legal heirs on record of deceased Appellant No.1 Laithabai Prabhu, who died on 20.06.2010.

The present Civil Application is filed on 22.07.2010 i.e. within time.

Considering the submissions made by the learned counsel for the Applicant, the averments made in the Application and as the Civil Application is filed within time, I am satisfied that the Applicant has made out a case for allowing the present Civil Application.

Hence, the following order:

a) Applicant is permitted to bring on record Sneha Chavan 1/2

12 caf 713-16=.doc the legal heirs of Appellant No.1 Lalitha in First Appeal No. 71 of 2004 within six weeks from today, failing which the Civil Application shall stand dismissed without further reference to the court. b) If amendment is carried out within stipulated time as stated hereinabove, applicant is directed to serve the amended copy of First Appeal memo as well as pending Civil Applications, if any, on Respondent's Advocate.

c) Civil application stands disposed off accordingly.
