The above Civil Application has been filed for restoration of the above Petition which stood dismissed for non-prosecution on account of the conditional order dated 14.08.2012 in respect of the non-payment of Bhatta charges. In view of the fact that the Bhatta charges are not required to be paid in view of Practice Note No.39, the above Writ Petition which was dismissed would have to be restored to file. The Civil Application is accordingly allowed. The Writ Petition is restored to file. Since the Petitioner has deposited the amount of Rs.45,46,575/- as directed by the interim order dated 27.10.2011 the interim relief would also stand reinstated. The Civil Application is accordingly disposed of. [R.M. SAVANT, J] BGP.
