At the outset, learned counsel for the applicant seeks leave to withdraw the application. He submits that the applicant has filed another application in the trial Court and that the applicant would like to pursue the said application, which is filed both on merits as well as on medical grounds.

The application is accordingly disposed of as withdrawn. It is made clear that this application has not been heard on merits. Learned Sessions Judge to decide the application filed by the applicant on its own merits, uninfluenced by the withdrawal of this application.
