This is an application through jail whereby the applicant/accused is praying for early hearing of his appeal. The applicant/accused is further praying that if his learned Advocate remains absent at the time of the hearing, some other advocate at the costs of the State, be provided to him. The order dated 8th avk 1/2
26-APPA-946-2018.doc January 2016 passed by this court shows that the appeal was expedited.
Even otherwise, as per contention of the applicant/accused, he is in jail for more than six years. Hence, the application is disposed of with a direction to the Registry to list the appeal for final hearing in the board commencing from 9th July 2018. It is clarified that if the learned Advocate engaged by the applicant/accused fails to remain present for final hearing, then the applicant/accused will be provided services of an advocate, at the costs of the State.
