This is an application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of bail.

The applicant came to be arrested in Crime No. 132 of 2018 registered at Bandgarden Police Station, Pune for the offences punishable under Sections 406, 420, 467, 468, 471, 120-B r/w.34 of Indian Penal Code, 1860.

I have heard the learned Counsel for the applicant and the learned APP for the State.

According to the prosecution, the present applicant and other co-accused extracted an amount of Rs.2,40,00,000/- from the complainant and the witnesses on the pretext that, they would get them appointed in government service.

The learned Counsel for the applicant submits that the applicant is in jail for more than 31⁄2 years. It is submitted that all the offences are triable by the Magistrate.

It appears that the trial Court has already framed the charges. Considering the nature of allegations, I am not inclined to release the applicant on bail. However, considering the fact that the applicant is in jail for more than 31⁄2 years, the trial Court shall endevour to conclude the trial as early as possible.

If the trial is not concluded within a period of six months, the applicant is at liberty to file bail application before the trial Court. The application is disposed of accordingly.
