The application is moved for pre arrest bail as the applicant/accused is facing charges for the offences punishable under Sections 406 and 420 read with 34 of the Indian Penal Code in C.R. No. 125 of 2015 registered with M.H.B. Colony police station, Mumbai.

None present for the applicant. The learned prosecutor has pointed out the order of granting interim relief to the applicant passed by this Court on 30th July, 2015. She pointed out that certain conditions were imposed especially the condition of payment of installments.

The complainant - bank has filed an application dated 1st September, 2015 contending that the applicant/accused has failed to deposit the installments after deposing first installment, as directed by an order dated 30th July, 2015 and now the applicant/accused is not appearing before the Court. Hence, criminal application No. 758 of 2015 is allowed.

In view of the above, anticipatory bail application No. 988 of 2015 stands rejected.
