After hearing the present application for bail during pendency of appeal, when it is ascertained by the Court that this is not a case for grant of bail during pendency of the appeal, moreover even during the trial the applicant was not on bail, learned Counsel for the applicant prayed for withdrawal of the application with further prayer that the appeal may be taken up for final adjudication expeditiously.
