The petition challenges an interim order passed by the Industrial Court at Nashik in a complaint filed by the Respondent union under Section 28 read with Items 9 and 10 of the Schedule IV of the Maharashtra Recognition of Trade Unions and Prevention of Unfair Labour Practices Act, 1971.

After the matter was heard at some length, it was adjourned to enable the parties to take instructions on whether the impugned order can be set aside and the matter can be remanded to the Industrial Court for final determination of the complaint in a time bound manner. Learned Counsel for both parties inform the court that the parties are agreeable to following such course. In the premises, the petition is disposed of by setting aside the

sat 2/2 wp 7869-2016.doc impugned order dated 22 June 2016 and directing the Industrial Court at Nashik to dispose of the main complaint, namely, Complaint (ULP) No.143/2016, as expeditiously as possible, and in any event, within a period of six months from today. All rights and contentions of the parties on merits are expressly kept open to be agitated before the Industrial Court. No order as to costs.
