P.C. :- By the impugned order dated 11 August 2000 the Industrial Court allowed the Application below Exhibit U-2 and restrained the Petitioner from transferring the services of the concerned workmen from Assembly Department to Transformer Department pursuant to the order dated 14 April 2000. At the time of issuance of Rule in this Petition on 30 August 2000, by a speaking order, this Court stayed the operation of the order dated 11 August 2000.

None appears for the parties. In view of the interim order passed on 30 August 2000 staying the order passed by the

WP 4513.00.sxw Industrial Court dated 11 August 2000, which was also an interim order and there was no stay to the proceedings in the complaint, it appears that due to passage of time cause of action does not survive. The Petition is disposed of as infructuous. (N.M. JAMDAR, J.)
