At the outset, learned A.P.P makes a statement, on the instructions of Police Naik - Mahadev K. Khedekar, Hatkanangale Police Station, Kolhapur, that during the pendency of the aforesaid application, charge-sheet has been filed in the said case on 23rd August 2021. 2.

In view of the statement made by learned APP, the learned counsel for the applicant does not press this application and seeks leave to withdraw the same with liberty to file a fresh application for bail, after filing of the charge-sheet, before the appropriate Court. N. S. Chitnis 1/2

Application is accordingly disposed of as withdrawn with liberty as prayed.

It is made clear, that the application has not been considered on merits and if an application for regular bail, after filing of the charge sheet is filed, the same shall be considered on its own merits, uninfluenced by the withdrawal of the aforesaid application.
