The Applicant has challenged the final order dated 09/06/2023 passed by the Special Executive Magistrate, Chembur Division, Mumbai, in Chapter Case No.11 of 2023. Since it is a final order, the Criminal Revision Application would be maintainable before the Court of Sessions. In the impugned order it is mentioned that the Applicant was informed that he could approach the Court of Sessions challenging the impugned order.

Considering this, the learned counsel for the Applicant seeks withdrawal of this Application with liberty to approach the Court of Sessions by filing the Criminal Revision Application. 3.

Permission to withdraw this application with such liberty is granted. In case, the question of delay in filing the said Criminal Revision Application is raised, the said Court shall consider the fact that the Applicant was pursuing the present application before this Court.

If such Revision Application is filed, it shall be decided in accordance with law.
